Terms of Sale and Use

These terms apply to Tabitha, a macOS app, and to licenses for it. By downloading, installing, or using Tabitha, you accept them. If you keep using Tabitha after a change to these terms, you accept the changed terms.

"We" and "us" in these terms mean David Schovanec. "You" means the person who uses Tabitha or buys a license.
Orders and payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Paddle's buyer terms apply to your purchase. Paddle collects payment, issues the invoice, and charges VAT or sales tax where it applies. Prices are shown in US dollars.
Free trial
Tabitha includes a free 14-day trial with every feature. When the trial ends, Tabitha stops replacing ⌘Tab until you enter a license key. The trial needs no payment details.
Your license
When you buy Tabitha, you get a personal, non-exclusive, non-transferable license to use it on every Mac you personally use. The license unlocks the current release and covers all 1.x versions of Tabitha and their updates. A future major version may be a paid upgrade. Your 1.x version keeps working.
You may not:
- share, sell, or publish your license key,
- resell, rent, or redistribute Tabitha,
- remove or work around the license check,
- decompile or reverse engineer Tabitha, except where the law allows it.
Acceptable use
Do not use Tabitha for unlawful purposes or fraud, to infringe anyone's intellectual property, or to interfere with the security of Tabitha or any other system.
Ownership
We keep all rights, title, and intellectual property in Tabitha, its name, and its website. A license gives you the right to use Tabitha as described here, not ownership of it.
No guarantee
We work hard to make Tabitha reliable, but we provide it as is. We do not guarantee that it runs without interruption or errors, or that it works with every future version of macOS. Your statutory rights as a consumer are not affected.
Liability
As far as the law allows, our total liability to you is limited to the amount you paid for your license. Nothing in these terms limits liability that the law does not allow us to limit.
Suspension and termination
We may end your license if you break these terms, if your payment is reversed or not made, or in case of fraud. You may stop using Tabitha at any time.
Refunds
You can get a full refund within 14 days of purchase. See the refund policy.
Privacy
The privacy policy explains what data Tabitha and this website process.
Governing law
Czech law governs these terms. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts.
